LIABILITY RELEASE FORM

PLEASE READ CAREFULLY! THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!

This Release and Waiver of Liability (the “Release”) executed by the undersigned (also referred to herein as either the “Volunteer” or “Homeowner”) on the date below in favor of His Handymen, Inc., A South Carolina nonprofit corporation, their directors, officers, employees, and agents (collectively, “Handymen”) for the Activities defined below. The undersigned desires to (1) work as a Volunteer for Handymen and engage in the activities related to being a Volunteer (the “Activities”) or (2) to permit Handymen to engage in the Activities for the Homeowner. The Volunteer understands that the Activities may include constructing and rehabilitating residential buildings, operating tools and equipment, working and traveling in Beaufort and Jasper counties of South Carolina.

The undersigned hereby freely, voluntarily, and without duress executes this Release under the following terms:

Release and Waiver: The undersigned does hereby release and forever discharge and hold harmless Handymen, its successors and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from the Activities of Handymen. The undersigned understands that this Release discharges Handymen from any liability or claim that the undersigned may have against Handymen with respect to any bodily injury, personal injury, illness, death, property damage or economic loss that may result from the Activities of Handymen, whether caused by the negligence of Handymen, its officers, directors, employees, volunteers or agents or otherwise. The undersigned agrees to pay any legal fees of Handymen in the event that legal action is brought against Handymen as a result of the Activities of Handymen. The undersigned also understands that Handymen does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.

Medical Treatment: The undersigned does hereby release and forever discharge Handymen from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Activities of Handymen.

Assumption of the Risk: The undersigned understands that the Activities includes work that may be hazardous to the undersigned, including, but not limited to, construction, loading and unloading, operation of equipment and tools, transportation to and from the work sites, and performing errands. Volunteer/Homeowner hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases Handymen from all damages or liability for injury, illness, death, property damage or economic loss resulting from the Activities. The undersigned agrees to pay any legal fees of Handymen in the event that legal action is brought against Handymen as a result of the Activities of Handymen.

Insurance: The undersigned understands that, except as otherwise agreed to by Handymen in writing, Handymen does not carry or maintain health, medical, or disability insurance coverage for any Volunteer or Homeowner. Each Volunteer/Homeowner is expected and encouraged to obtain his or her own medical or health insurance coverage.

Photographic Release: The undersigned does hereby grant and convey unto Handymen all right, title, and interest in any and all photographic images and video or audio recordings made by Handymen during the Activities with Handymen, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

Other: The undersigned expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of South Carolina, and that this Release shall be governed by and interpreted in accordance with the laws of the State of South Carolina. The undersigned agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this release which shall continue to be enforceable.
